These Terms of Service (“Terms”) govern your use of exxo.com.au (“Site”) and purchases made from EXXO.
The Site is operated by EXXO Brands Pty Ltd (ABN 73 689 851 223), trading as EXXO (“we”, “us” or “our”).
Our registered business address is 7/3 GDT Seccombe Close, Coffs Harbour NSW 2450, Australia. Orders are dispatched from our warehouse at 221 Gooderham Road, Willawong QLD 4110, Australia.
By using the Site or placing an order, you agree to these Terms.
Use of the Website
You may use the Site only for lawful purposes.
You must not use the Site in a way that breaches applicable laws, infringes another person’s rights, compromises the Site’s security or interferes with its operation.
We may restrict access where we reasonably believe misuse, fraud or unlawful activity has occurred.
Products and Availability
We make reasonable efforts to ensure product descriptions, specifications, dimensions, images, availability and prices are accurate.
Product colours and appearance may vary slightly because of lighting, photography, screen settings or manufacturing changes. Images may include accessories or props that are not included unless stated in the product description.
All products are subject to availability. If an ordered product becomes unavailable, we will contact you and offer an alternative, a revised delivery timeframe or a refund for the affected item.
Prices and Payments
Prices are displayed in Australian dollars and include GST where applicable.
By placing an order, you confirm that:

Payments are processed securely by approved third-party payment providers.
If a pricing error affects your order, we will contact you and allow you to proceed at the correct price or cancel the affected item for a refund.
Orders
Submitting an order is an offer to purchase the products in your cart. An automated confirmation acknowledges that we received your order.
We may cancel or refuse an order where a product is unavailable, payment cannot be authorised, information is incorrect, fraud is suspected or delivery cannot reasonably be completed.
If we cancel an order after payment, we will refund the amount paid for the cancelled products.
Dispatch and Delivery
Delivery terms and estimated timeframes are explained in our Shipping Policy, which forms part of these Terms.
We generally aim to process and dispatch in-stock orders within 24 hours on business days. Orders placed after the dispatch cut-off, on weekends or public holidays will generally be processed on the next business day.
“Ships Today”, “Ships Tomorrow” and similar messages are dispatch estimates based on normal warehouse operations. They are not guaranteed delivery dates.
Delivery may be delayed by couriers, weather, peak periods, remote locations or other circumstances outside our reasonable control.
Customers are responsible for providing an accurate and complete delivery address.
Returns and Refunds
Our Refund & Returns Policy explains our 30-day return period, eligibility requirements, return costs, exchanges and refund process.
Change-of-mind returns may require the customer to pay return-delivery costs.
Different rules apply when a product is faulty, damaged, unsafe, incorrectly described or otherwise fails to meet a consumer guarantee.
Contact hello@exxo.com.au before returning a product so we can provide the correct return instructions and address.
Australian Consumer Law
Our products come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms or our policies excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.
Depending on the circumstances, customers may be entitled to a repair, replacement, refund or other remedy where a product fails to meet an applicable consumer guarantee.
Product Use
Customers must follow all product instructions, assembly directions and safety warnings.
Products intended for children or animals must be used with suitable supervision and checked regularly for damage or wear.
To the extent permitted by law, we are not responsible for damage caused by misuse, incorrect assembly, unauthorised modification or use outside the product’s intended purpose.
Intellectual Property
The Site’s content, including its text, images, logos, graphics and design, is owned by or licensed to EXXO and is protected by intellectual-property laws.
Site content may be used for personal, non-commercial purposes only. It must not be reproduced or commercially exploited without our written permission.
Customer Content
If you submit reviews, feedback, photographs or videos, you confirm that you have permission to provide that content and that it does not infringe another person’s rights.
You grant EXXO a non-exclusive, worldwide, royalty-free licence to use that content for business, promotional and customer-communication purposes.
We may remove content that is unlawful, misleading, offensive or unrelated to a genuine customer experience.
Third-Party Services
The Site may use or link to third-party payment, delivery, review or social-media services.
Those services operate under their own terms and privacy practices. We are not responsible for third-party services that we do not own or control.
Privacy
Our handling of personal information is explained in our Privacy Policy.
Liability
Nothing in these Terms limits liability or customer rights that cannot legally be limited.
To the extent permitted by law, EXXO is not responsible for indirect or consequential loss that was not reasonably foreseeable.
Changes to These Terms
We may update these Terms when our services, practices or legal obligations change.
The current version and its latest update date will be published on the Site.
Governing Law
These Terms are governed by the laws of Queensland, Australia.
Nothing in this section prevents a customer from exercising rights available under applicable Australian consumer law.
